Bombay High Court Allows MHADA to Use Unclaimed Patra Chawl Flats for Public Housing

Mumbai, April 2026: The Bombay High Court has ruled that the Maharashtra Housing and Area Development Authority (MHADA) can use unclaimed flats in the Patra Chawl redevelopment project for public housing, if original allottees fail to take possession within the stipulated deadline.


Deadline Set for Allottees

The court directed members of the Goregaon-based housing society to take possession of their flats by April 30, 2026. If they fail to do so, MHADA will be permitted to allocate these units for public housing purposes.

The court observed that sufficient time had already been granted to residents to resolve disputes and move into the completed buildings.


Flats Ready, Delays Unjustified

A bench of Justices Girish Kulkarni and Aarti Sathe noted that the rehabilitation buildings are complete and ready for occupation, and ongoing disputes should not delay possession any further.

The ruling aims to ensure that completed housing stock does not remain unused amid a shortage of affordable housing.


Option to Reclaim Later

The court clarified that even if flats are reallocated, original beneficiaries can still claim possession later, provided they give a three-month prior notice.

This provision balances public interest with the rights of original allottees.


Lease Rent Must Be Paid

Addressing another key issue, the court stated that since the land belongs to MHADA and is public property, lease rent cannot be waived and must be paid as per policy.


Background of the Project

The Patra Chawl redevelopment project in Goregaon has been delayed for years due to legal disputes, financial irregularities, and issues with the original developer.

The project aims to rehabilitate hundreds of displaced families while also creating additional housing stock.
